Asbestos has been used in construction for over a century. It has also been known to cause deadly diseases for nearly as long. Understanding why asbestos is dangerous, and what the legal and practical implications are for property owners, is essential knowledge for anyone managing, buying, or renovating real estate.
Why Asbestos Fibers Are Uniquely Hazardous
What makes asbestos uniquely dangerous is not just its toxicity but its physical properties. While asbestos can be visible within building materials, the individual fibers released when those materials are disturbed are microscopic, far too small to see or feel, and can remain suspended in air for hours. Once inhaled, the fibers embed in lung tissue and the lining of the chest cavity (the pleura). The human body has no effective mechanism for expelling or breaking them down.
Unlike many environmental toxins, asbestos does not cause immediate symptoms at the point of exposure. The damage is cumulative and long-latency, meaning diseases typically emerge 20 to 50 years after initial exposure. By the time a diagnosis is made, decades have passed and exposure history can be difficult to trace.
Mesothelioma: The Disease Most Associated with Asbestos
Mesothelioma is a rare and aggressive cancer of the mesothelium, the thin layer of tissue covering the lungs, heart, and abdominal organs. It is caused almost exclusively by asbestos exposure. There is no safe level of asbestos exposure with respect to mesothelioma risk.
Mesothelioma has a poor prognosis: median survival from diagnosis is typically 12 to 21 months. Approximately 3,000 Americans are diagnosed each year. Because the disease has a latency period of 20 to 50 years, many current patients were exposed during occupational or residential contact with asbestos-containing materials in the 1960s, 1970s, and 1980s.
Asbestosis and Other Asbestos-Related Conditions
Asbestosis is a chronic, progressive fibrosis of the lungs caused by inhalation of asbestos fibers. Over time, scar tissue replaces functional lung tissue, reducing respiratory capacity and causing shortness of breath, persistent cough, and in severe cases, respiratory failure. There is no cure.
Asbestos exposure also significantly elevates risk of lung cancer, particularly in combination with smoking. Pleural plaques, calcified deposits on the lining of the lungs, are a common marker of prior asbestos exposure and, while not cancerous themselves, indicate that fiber inhalation has occurred.
The Legal Liability Picture for Property Owners
Beyond health risk, property owners face meaningful legal and financial liability if asbestos-containing materials are not properly identified and managed. Federal and state environmental regulations require asbestos surveys before renovation and demolition projects above certain thresholds. OSHA regulations govern worker exposure limits on job sites.
Property owners who fail to disclose known asbestos in real estate transactions may face civil liability. Landlords who allow tenants to be exposed to deteriorating asbestos-containing materials face liability for resulting health consequences. In litigation, the question of what the property owner knew and when they knew it is central, and professional testing creates a documented record.
When Asbestos Is Not Dangerous
It is important to note that not all asbestos-containing materials present an immediate danger. Asbestos-containing materials that are intact, in good condition, and not subject to disturbance are generally considered non-friable and poses minimal immediate risk. The EPA's recommended approach for intact asbestos-containing materials in good condition is often to leave them in place and monitor their condition.
Professional testing tells you what you have and where it is. That knowledge allows you to make informed decisions about management, encapsulation, or removal, rather than operating in ignorance and inadvertently creating a hazard through uninformed renovation work.
The Case for Testing Before Any Disturbance
The health and legal case for asbestos testing before renovation, demolition, or any significant disturbance of pre-1980 building materials is compelling. Testing is fast, affordable relative to remediation costs, and creates a documented baseline.
